This page does not by itself create safe harbour. Publishing an agent here is only half of it. The same agent has to be registered with the United States Copyright Office in the DMCA Designated Agent Directory, and that registration has to be renewed every three years. Until that filing is made, the 17 U.S.C. 512(c) safe harbour is not available no matter what this page says. See the checklist at the end.

What Mobytape hosts

Mobytape reports on public market data from Polymarket and Kalshi, and on wallet activity those venues publish. Most of what you see here is factual market information rather than creative work. The parts a notice could reasonably concern are the things users supply: account display names, alert rule names, and any text a user submits. We act on notices about that material.

Sending a takedown notice

To be effective under 17 U.S.C. 512(c)(3), your notice must include all of the following:

Send it to the designated agent above. We aim to acknowledge within [3] business days and to act on a complete notice promptly.

Misrepresenting that material is infringing can make you liable for damages, including costs and legal fees, under 17 U.S.C. 512(f). If you are unsure whether a use is infringing, take advice before sending.

What happens next

If a notice is complete, we remove or disable access to the material and make a reasonable effort to tell the user who supplied it, passing on a copy of the notice. If a notice is incomplete, we will say what is missing.

Counter notice

If your material was removed and you believe that was a mistake or a misidentification, you can send a counter notice to the same agent. It must include your signature, identification of the material and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed by mistake, your name, address and telephone number, and your consent to the jurisdiction of the federal district court for your address, or for [JUDICIAL DISTRICT] if you are outside the United States, and to accept service from the person who sent the original notice.

If we receive a valid counter notice, we forward it to the original complainant. Unless they tell us they have filed a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. A record of notices received is kept against the account so that decision can be made consistently.
